General Terms of Use

The following General Terms of Use and Privacy Policy set out the legal framework for the use of the FitFip application (FitFip-powered applications) for the services we offer to our members.

Please read these General Terms and the Privacy Policy carefully.

Terms of Use

1.1 Contracting parties and subject matter of the contract

These Terms of Use form the basis of the user/member agreement concluded between you and us as FitFip, Georgiou Seferi 38, Heraklion, Crete 71601 (hereinafter referred to as "we" or "us").
The subject matter of this agreement is the use, free of charge or for a fee, of the services we offer under the name FitFip or other specific software applications (powered by FitFip apps), hereinafter individually referred to as "FitFip Service" or collectively as "FitFip Services" or FitFip platform or FitFip application or generally as "FitFip".
A prerequisite for opening a user account and using FitFip Services is that you are at least 18 years old and have full legal capacity.
The FitFip application is intended exclusively for consumers. Your use of FitFip for commercial purposes of any kind is expressly prohibited.
We reserve the right to add additional terms and conditions for specific FitFip Services. However, we will notify you thereof in due time before use.
Should any individual provisions of these Terms of Use become wholly or partially invalid, this shall not affect the validity of the remaining provisions.

Platform Description

FitFip is a platform connecting members with sports businesses, e.g., gyms, personal training facilities, etc., allowing its members to access, view, and manage offered services and products provided exclusively by the sports businesses to which you have directly subscribed. Examples of sports business services include exercise programs, workouts, participation in group programs, etc.
The use of the FitFip application is provided free of charge. However, the services offered by sports businesses are subject to our subscription with the sports business.

Liability - Terms and conditions regarding your health.

FitFip allows access to services provided exclusively by sports businesses. The content displayed is entered and managed by the sports businesses. Therefore, we bear no responsibility whatsoever for any change in your health condition.
If you are aware of any medical condition, we advise you to urgently seek medical advice and simultaneously inform the sports business. Furthermore, the explanations of exercises and routines included in the application are for guidance only. In any case, they constitute recommendations for you. In case of any injury caused by exercise, you will be responsible for the injury and in no case FitFip.
Similarly, we recommend caution regarding products that may be promoted by sports businesses (service on a case-by-case basis of the sports business). In the case of nutrition-related products, you are responsible for verifying that the foods and nutrients mentioned do not contain ingredients or content to which you are allergic or which may cause food intolerance or other side effects.
In any case, FitFip prohibits the distribution of products not approved by national and international health organizations such as E.F.E.T. Greece, FDA USA, EFSA (European Food Safety Authority), etc. Should you identify any product falling into a prohibited category, please inform us immediately at contact@fitfip.com so that we can take immediate blocking actions.
The distribution and sale of products are provided exclusively by sports businesses. FitFip merely provides the ability to sell a product at the displayed price by the sports business itself. The transaction takes place between you and the sports business.
The user has the right to cancel the order as long as its status remains "Registered". Cancellation can be made through the application or by sending an email to [orders@fitfip.com]. After the order status changes to any subsequent phase (e.g., "Processing", "Completed", etc.), cancellation is no longer possible and no refund is provided, unless the cancellation is caused by the fault of the service provider or due to force majeure. In case of valid cancellation, the amount is refunded to the user within 14 working days. The refund may be reduced by third-party payment provider transaction fees (such as Stripe, PayPal, banks), which are non-refundable. If the order is cancelled by the provider (e.g., due to inability to perform), the user is entitled to a full refund, including third-party charges.
Consumers enjoy protection under a variety of laws in different jurisdictions around the world, and our members will use FitFip as consumers. Always bearing in mind exceptions found in various countries around the world, there are certain types of liability which we are permitted by law to limit or exclude and, consequently, WE SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT OR CONSEQUENTIAL LOSS, DAMAGE OR EXPENSES (INCLUDING LOSS OF PROFITS, DATA, BUSINESS, ETC.) WHICH YOU MAY INCUR AS A RESULT OF USING FITFIP SERVICES. In case you are wondering why this part needs to be capitalized, it is to comply with the laws of certain jurisdictions, including some states in the USA. Furthermore, WE SHALL NOT BE OBLIGATED OR LIABLE FOR ANY FAILURE TO PERFORM OR FOR THE DELAY IN PERFORMANCE OF ANY OF OUR OBLIGATIONS UNDER THESE TERMS CAUSED BY EVENTS BEYOND OUR REASONABLE CONTROL. This may include the failure of an Internet service provider to deliver notices or emails to you.
If we happen to make a statement that turns out to be untrue (whether orally or in writing) before your registration, then, unless that statement was made fraudulently by us, we will only be liable to you if that untrue statement leads to a breach of these Terms by us. If it does not, the untrue statement has no effect on our relationship with you, except to the extent that it may affect your statutory rights as a consumer. These limitations and exclusions of liability shall survive the termination of your registration (which, in turn, terminates our contract with you).
To ensure that members are satisfied and the application works effectively, we may monitor the data transmitted by you to us. This DOES NOT mean, however, that we are obliged to do so and we assume no responsibility for it. However, as stated above, we may remove content you have uploaded if that content violates these Terms or if you violate these Terms. An example is socially unacceptable profile photos, e.g., racist, that generally offend social groups.

Registration

To gain access to our services, you must register. Acceptance of all Terms of Use is required for registration. If you do not accept all of these Terms of Use, the use of the application is prohibited. When you complete your registration by accepting these Terms of Use, there will be a legal contract between you and us. You have the right to cancel your account at any time, without stating any reason, as well as to terminate your consent to the Terms of Use, resulting in the immediate cessation of our services. To do this, you must contact us at contact@fitfip.com. Please note that after you cancel your member account, we will delete all content you added and you will no longer have access to the content you created while using the application. If at the time of your account deletion you still have a current subscription to a sports business or have purchased an additional service that has not yet expired or a product, then you should contact the business directly.
We are entitled to cancel your user agreement with immediate effect and cancel your account if you seriously or repeatedly violate the provisions of the user agreement and/or these General Terms. Unless we terminate your contract, it remains in force.

The Service

As an innovative company, we believe in the continuous evolution of our services and in providing reliable functionality. We are constantly working on new features and occasionally, we may want to replace older features with new, better ones. We reserve the right, in accordance with these Terms of Use, to add or remove features and functionalities. We will do our best to notify you in advance, but from time to time, this may not be possible. For example, if something stops working and is too complex to fix and is not popular enough to justify fixing it, we may decide to withdraw it immediately. This withdrawal may be temporary or permanent, and we always have the exclusive right to decide what is best in the circumstances. In parallel, new functionality may require changes or additions to these Terms of Use or the Privacy Policy, so when we launch new features, you may want to check if we have made changes to either.
